1. Acceptance and business authority

These Terms apply to access to the Serberus website, application, public customer workflows, and related services. The provider will be the legal entity identified in the applicable order form or checkout record.

By accepting an order form or using a paid Serberus account, you confirm that you are legally able to bind the business you represent and that authorized users will follow these Terms.

2. The service and order of documents

Serberus is configurable field service operations software for intake, quoting, scheduling, dispatch, job delivery, communications, invoicing, reporting, and related workflows. Features may depend on the selected plan, configuration, connected providers, and technical availability.

A signed order form, data processing addendum, or written service schedule may add or change terms for a specific customer. If documents conflict, the signed order form controls for commercial details, the data processing addendum controls for personal information, and these Terms control otherwise.

3. Accounts and administrators

The customer is responsible for its administrators, role assignments, user access, accurate account information, and the security of credentials and connected services. Accounts may not be shared outside the authorized business.

The customer must promptly remove access for people who no longer require it and notify Serberus through the support channel identified in its order form if unauthorized access is suspected.

4. Automations and AI-assisted features

Serberus provides configurable workflow software. Automations run according to rules and settings selected by the customer. Depending on configuration, Serberus may calculate quote totals from the customer catalogue, display booking slots from availability inputs, assign technicians, send communications, create draft invoices, and prepare recovery actions.

The customer remains responsible for its rules, prices, taxes, service areas, staffing, content, and legal compliance. Serberus keeps configured actions visible and routes designated exceptions for review, but the customer must not assume every error or exception will be detected.

Automated or AI-generated output may be incomplete or incorrect and must be reviewed before any safety-critical, legal, tax, accounting, employment, or trade decision.

5. Customer data and privacy responsibilities

As between the parties, the customer owns the business content and personal information it submits to Serberus. The customer gives Serberus a limited right to host, process, transmit, and back up that information only as needed to provide, protect, and improve the contracted service.

The customer is responsible for lawful collection, notices, consent, retention instructions, employee and technician monitoring, customer communications, and responding to people whose information it controls. Serberus may refer an end customer or worker to the relevant business when that business controls the information.

6. Communications and acceptable use

The customer is responsible for compliance with CASL, privacy law, consumer law, employment rules, trade requirements, and any other law that applies to its messages and services.

  • Do not send spam, harassment, unlawful content, malware, or communications without a valid basis.
  • Do not upload information you are not authorized to use, including highly sensitive information that is unnecessary for field service work.
  • Do not bypass access controls, scrape the service, share credentials, reverse engineer protected components, or interfere with other customers.
  • Respect opt-outs, identification requirements, and unsubscribe requests within the time required by law.

7. Fees, subscriptions, and taxes

Any paid subscription requires an order form or checkout record that states the price, included usage, overages, billing interval, renewal, cancellation, refunds, onboarding charges, and applicable taxes before purchase. Those commercial details are not created by this pre-launch draft.

Unless a signed order form says otherwise, the customer remains responsible for taxes connected to its purchase and for keeping payment information current. Serberus will not represent a trial, refund, or cancellation right that has not been confirmed in writing.

8. Customer payments and third-party services

Serberus can support invoice records, payment status, credits, and connected payment workflows. Payment processors, messaging carriers, identity providers, mapping services, accounting providers, and other integrations are governed by their own terms. Availability may change and a connected provider may suspend or limit its service.

The customer is responsible for its relationship with any provider it connects and for confirming payment, tax, accounting, communication, and mapping results before relying on them.

9. Intellectual property, feedback, and confidentiality

Serberus and its licensors retain all rights in the software, design, documentation, and service improvements. The customer may use the service only during its authorized subscription and may not resell or sublicense it unless a written agreement allows it.

If the customer provides feedback, Serberus may use it without identifying the customer or disclosing confidential information. Each party must protect the other party's confidential information with reasonable care and use it only for the business relationship.

10. Availability, changes, and support

Serberus may maintain, secure, modify, or discontinue parts of the service. Planned material changes will be communicated when reasonably possible. No service level, uptime guarantee, backup commitment, or support response time applies unless it is written in an order form.

11. Suspension and termination

Access may be limited or suspended when needed to address a security threat, unlawful use, material breach, non-payment under an order form, or risk to other users. Where practical, Serberus will provide notice and an opportunity to resolve the issue.

Termination, export access, and deletion timing will follow the applicable order form and privacy obligations. No deletion window should be assumed unless it is confirmed in writing.

12. Disclaimers, liability, and indemnity

To the extent permitted by law, the service is provided without implied guarantees beyond those that cannot legally be excluded. The customer must verify operational, safety, tax, accounting, and legal decisions. Nothing in these Terms excludes liability that cannot be excluded, including liability for intentional or gross fault or for bodily or moral injury where applicable.

Final warranty disclaimers, liability limits, and indemnities must be set in the signed order form and reviewed by Quebec counsel before commercial launch.

13. Governing law, language, and contact

These Terms are intended to be governed by the laws of Quebec and the federal laws of Canada that apply there, subject to the governing district confirmed in the order form and any mandatory consumer or privacy law.

The French version must be made available before any express choice to be bound by an English version where Quebec language law requires it.

Until a direct legal contact is published, questions must be sent through the support channel identified in the customer's Serberus account or order form. The legal entity, address, and direct contact will be inserted before general commercial availability.
